Justa Adaptação Urbana na Implementação do Direito à Cidade
uma leitura do art. 3º, I, da Lei n. 14.904/24

As cidades tendem a ser as principais afetadas pelos efeitos das mudanças climáticas, sendo necessário adaptar-se ao clima presente e futuro. O Brasil estabeleceu a Lei n.14.904/24, com diretrizes gerais para planos de adaptação. Entre as áreas prioritárias desta Lei está o direito à cidade, noção ainda em disputa no país. Neste contexto, o presente trabalho propõe analisar as relações entre o conceito de direito à cidade do referido artigo e a ideia de justa adaptação urbana, presente na literatura recente da área de adaptação climática. Parte-se do pressuposto de que uma leitura do direito à cidade pela ótica da justa adaptação urbana poderia, em tese, levar a melhores resultados adaptativos. Para tanto, foi realizada uma pesquisa qualitativa e exploratória, utilizando do método dedutivo a partir de uma revisão bibliográfica. Conclui-se que os dois conceitos estão bastante relacionados, e uma leitura do direito à cidade através da justa adaptação urbana corroboraria com a realização deste, assim como com bons resultados adaptativos, em tese.
